Dietary services
1. Concepts
These Regulations define the rules for the use of dietary services provided by the Kitchen Alergika - Anna Gałązka for Patients.
Dietitian - Anna Gałązka
Patient - any person who:
- is over 16 years of age and uses the dietetic services of a Dietitian or a person under 16 years of age after presenting a written consent of the Parent or Guardian to use the services,
-accepts these Regulations and orders the service offered by the Dietician.Materials - diets, nutritional plans, dietary advice, written nutritional education materials, hereinafter also referred to as Diet.
Service - nutritional plan, consultation
The regulations apply to on-line consultations by phone, via Skype or by correspondence - via Facebook, Instagram or by e-mail.
Each Patient using the dietary services of the Kitchen Allergic Group agrees and accepts the provisions of these regulations. If the patient does not agree with any of the sub-items - he or she cannot use the services.
2. General provisions
1. The Regulations define the detailed rules for the use of Dietary Services.
2. A patient who has completed the Nutritional Interview in the form of a questionnaire and accepted the terms of the regulations is considered to have concluded a dietary service agreement on the terms set out in the Regulations.
3. The patient accepts the Regulations after checking the appropriate box in the questionnaire with the Nutritional Interview, thus accepting its terms.
4. The dietitian has professional knowledge and education in the field of dietetics as well as the necessary organizational and technical measures to provide dietary services with due diligence required for the entrepreneur.
5. The contract for the provision of dietary services is an agreement of careful operation and the Dietitian is not responsible for the lack of the effects of using the services expected by the Patient, due to the complexity and multiplicity of side factors affecting the effect of these services, which is independent of the Dietitian and cannot be only be compensated by the Services used. Nevertheless, the Dietitian will provide with due diligence, taking into account professional knowledge and methods optimal for each case.
6. The dietitian is not responsible for improper, irregular use or complete cessation of the recommendations resulting from the Service by the Patient.
3. Patient's rights and obligations
The patient personally provides the Dietitian with all necessary information in order to prepare a nutritional and medical interview, which is necessary for the Dietician to create a proper diet and to establish appropriate dietary and health recommendations.
When using the services of a Dietitian, the Patient is obliged to provide the Dietitian only with true data and to inform the Dietician about their changes each time.
The patient will not make any changes to the diets prepared by the Dietitian on his own, he is obliged to consult the Dietitian on the willingness to introduce changes to the Dietitian's recommendations and diets prepared by him.
If the Patient provides incomplete or untrue information about his health, and does not inform about a change in his health, the Dietitian is not responsible for the consequences of the Patient's use of the planned diet.
In case of any doubts, the Patient should consult a physician before starting the diet.
If, during the Nutritional and Medical Interview, the Patient has not provided a complete answer to the question about culinary tastes or health status, he may complete the missing information BEFORE the Dietitian starts composing the Diet. If you find out about it later, the Dietitian is not responsible for the consequences of using the Diet or for your culinary taste.
If there is a justified need, the Patient contacts the Dietitian by e-mail, telephone or via the Facebook and Instagram platforms.
The patient agrees to the dietary therapy and undertakes to follow the diet prepared by the Dietician.
The patient is obliged to inform about any health problems that arise in the course of following the recommendations.
If the patient completes the treatment and wishes to show off the results in the form of a "before" and "after" photo, he can send them by e-mail or via the Facebook or Instagram platform. This is tantamount to the consent of the patient and his placement on the website of Kuchnia Alergika and social media such as Facebook or Instagram.
4. The rights and obligations of a dietitian
During the first interview, the dietitian conducts a thorough nutritional and medical interview. Thus, the patient provides the data needed to determine individual nutritional recommendations and the arrangement of the diet, along with any answers to additional questions asked by the patient during the consultation.
A dietitian provides the following Dietary Services:
- conducting consultations (in electronic mode),
- assessment of the eating style so far,
- arranging individual menus and recommendations,
- medical and nutritional interview,
- evaluation of laboratory results,
- preparation of supplementation plans,
- nutritional education,
- making it possible to book and change the date of a visit,
- asking questions by e-mail and by phone,After the Patient has fulfilled the above obligations, the Dietitian undertakes to arrange an individual diet within 5 days of receiving payment for the service.
If there is a justified need, the Dietitian contacts the Patient via e-mail, telephone and the Facebook or Instagram platform.
All free corrections to the menus will be made within 5 days from the confirmation of receipt of the message with the nutritional plan.
The dietitian has the right to terminate the cooperation with the patient if the patient does not want to follow the recommendations and in the absence of contact from the patient (no reports, no replies to messages), for a period longer than 3 weeks.
Contact with a Dietitian is possible from Monday to Sunday from 8:00 to 20:00. In exceptional situations, contact after hours is allowed.
5. Payment and payment rules for services
A dietitian provides dietary advice, consultations in the field of healthy eating and health education, determines detailed recommendations regarding nutrition and lifestyle, arranges individual diets as well as for couples and groups.
Diets, along with recommendations for their use, are sent to the e-mail address provided by the Patient or another correspondence chosen by him.
After the first conversation and willingness to express cooperation, the Patient makes the full payment by bank transfer.

6. Cancellation and postponement of visits, changes and refunds
If it is necessary for the Patient to cancel an agreed consultation, it is possible to postpone it to another date, provided that the consultation is canceled at least 24 hours in advance. If the condition is not met, the meeting is forfeited. Only in exceptional cases determined individually, it is possible to omit this rule.
In exceptional situations, the consultation may be canceled by the Dietitian 24 hours in advance - then a new date of the visit will be set.
Each diet is determined individually and is preceded by a detailed nutritional and medical interview in the form of a questionnaire completed after the first interview and an analysis of the nutritional diary filled by the patient. These treatments are aimed at learning about the patient's preferences, lifestyle and health condition.
If the Patient, after receiving the diet, wishes to change individual dishes (a matter of culinary taste),
in justified cases, modification is allowed
-up to 3 dishes in the 7-day menu
-5 dishes in the 14-day menu.
Each major modification will result in payment for the service as for a new Diet. All free corrections to the menus will be made within 5 days from the confirmation of receipt of the e-mail or the nutritional plan sent by other, preferred by the Patient by correspondence.The arranged menu is not returnable.
If the patient has made an appointment for an online consultation and does not contact the Dietitian within 15 minutes after the scheduled start of the consultation, the dietitian is not obliged to refund the fee paid by the patient.
7. Privacy protection
1. The administrator of personal data provided in connection with the implementation of this contract for the provision of dietary services is Kuchnia Alergika - Anna Gałązka.
2. Personal data will be processed in order to implement this contract for the provision of dietary services, including:
a) establishing the patient's identity before providing the service,
b) making an appointment by phone,
c) contact for confirmation, cancellation, postponement of consultations or arranging its details,
d) storage of documentation regarding the patient's health condition, established diet plan and other details related to the provided service,
e) receiving and archiving statements about persons authorized to access the patient's medical records and information about his health.
3. Personal data will be kept for the time necessary to perform the contract for the provision of dietary services, the legally required period of storing medical documentation and pursuing possible claims.
4. The data subject has the right to request access to their personal data, rectification, deletion and the right to limit their processing. In addition, the right to withdraw consent at any time without affecting the lawfulness of the processing, which was made on the basis of consent expressed before its withdrawal, as well as the right to transfer data and object to the processing of personal data.
5. If it is found that the processing of personal data violates the provisions on personal data, the data subject may lodge a complaint with the President of the Personal Data Protection Office.
6. The basis for the processing of personal data is the patient's consent. Providing personal data is voluntary, however, the lack of consent to the processing of data makes it impossible to implement this contract, in particular to arrange consultations and perform dietary services.
7. Personal data will not be processed in an automated manner and will not be profiled.
8. Final provisions
The regulations are valid from 01/01/2022 and may be changed at any time. The dietitian is obliged to inform the patient about the changes.
Consultations made by a Dietitian are informative and do not replace medical advice.
The patient acknowledges that the diet prepared for him is developed with care for his health, according to the individual interpretation of the state of health, test results, and is based on the professional knowledge and experience of a Nutritionist. The services provided by the Dietitian do not guarantee the desired effect due to the complexity of the human body and environmental factors affecting the effect of dietary advice. Therefore, the dietitian is not responsible for the lack of the expected effects or for the negative effects of using the diet. Moreover, the visits are based on the conviction that the Patient did not conceal any information, and in the Nutritional and Medical Interview, he only stated the truth.
The dietitian may refuse to provide the Patient with a service or consultation if:
the patient's behavior proves that he is insane, shows offensive behavior and violates the personal rights of a Dietician
providing a consultation or providing a service could endanger the patient's health or life,
giving a consultation or providing a service exceeds the skills or knowledge of a Dietitian.
Each service, consultation and all information related to them are prepared individually for a specific patient and constitute the intellectual property of the Allergic's Kitchen - are adequately protected. It is forbidden to distribute, copy, resell, make available publicly or individually without the written consent of the Dietician. In the event of non-compliance with the above prohibition, the Patient will be subject to criminal and property liability. The Patient has the right to download, print and process the Materials for their own use, provided that they do not infringe the copyright.
